By accessing or using TellATell ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes acceptance of any modifications.

TellATell is an anonymous question and answer platform that allows users to receive and respond to anonymous messages ("tells"). The Service is provided "as is" and we make no guarantees regarding its availability, accuracy, or reliability.

3. User Accounts

• You must be at least 13 years old to use this Service
• You are responsible for maintaining the security of your account
• You must provide accurate and complete information when creating an account
• You may not use another person's account without permission
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. User Content & Conduct

4.1 Your Content

You retain ownership of content you create. By posting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service.

4.2 Prohibited Content

You agree not to post or transmit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Contains hate speech or discrimination based on race, gender, religion, etc.

5. Anonymity & Privacy

While we provide anonymous messaging features:

• Anonymity is not absolute – we collect certain data for abuse prevention and rate limiting
• If you are logged in while sending tells, your account is linked internally for safety purposes
• We may reveal information to law enforcement when legally required
• Recipients cannot see sender identity for anonymous tells, but administrators may access it for moderation
• Do not rely on anonymity for illegal activities

6. Premium Subscriptions (TellATell Plus)

6.1 Subscription Terms

TellATell Plus is a premium subscription that provides additional features. By subscribing, you agree to the following terms:

• Subscriptions are billed on a recurring basis (monthly or annually)
• You authorize us to charge your payment method automatically
• Prices may change with notice; changes apply at the next billing cycle

6.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain Plus features until then.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by TellATell and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8. Third-Party Links & Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your interactions with third-party services are governed by their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELLATELL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless TellATell and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account at any time, with or without cause or notice. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account and content
• Any outstanding subscription payments remain non-refundable
• Sections that by their nature should survive will survive termination

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
